CRIMINAL SECTION
Further to the introduction of a new Code of Criminal Procedure, this section has specially been created for carrying out defensive inquiries. All evidence gathered within the law has the same probative value, no matter whether collected by the prosecution or by the defence, and is filed under "defence" at the Investigating Magistrate's office.
law n°397 (December, 7th 2000), with the introduction of the Title VI, Book V of the new Code of Criminal Procedure, has given more power to the defence in collecting evidence to be used in trial, within the framework of a general levelling process between defence and prosecution.
In this way, an organic body of laws concerning private investigations has been introduced, which enable the defence to collect evidence in favour of the client since the beginning of the criminal proceedings and, within limits, even before.
Since these rules were introduced, the role of a private detective has become a more important one, as far as defensive inquiries are concerned (391 bis C.C.P.), which is that of an assistant of the counsel for the defence.
An authorization by the cognizant prefect is necessary before a private detective can cooperate with the counsel of defence, thus beginning to collect evidence, make inspections or search for witnessew, etc., always in compliance with the provisions of the Code of Criminal Procedure and Legislative Decree 196/2003, concerning the privacy code (collection, handling and dissemination of personal data).
